Deaf Immigrant Awarded $250K Settlement

ARLINGTON, VA -- NBC4 Washington: A Deaf man will receive a $250,000 settlement from the Arlington County Sheriff's Office after it failed to provide a sign language interpreter for him while he was jailed, the U.S. Attorney's Office announced Friday.



The man, Abreham Zemedagegehu, has said he spent part of his six-week stay at the Arlington County Detention Facility in 2014 unaware of the charges against him. The Justice Department launched an investigation into Zemedagegehu's claim last year.





NBC News covered a story about Abreham Zemedagegehu and his experience in jail without an interpreter.



"I felt like I was losing my mind," Zemedagegehu said through an interpreter in an interview at his lawyer's office. "I thought Virginia would give me an interpreter and they said no. That's why I felt lost."



Zemedagegehu also said the jail failed provide a communications device to help him communicate with his lawyer and performed medical procedures on him without explaining them or getting his consent.



A native of Ethiopia, he can communicate in American Sign Language but is largely unable to communicate in written English.



Zemedagegehu sued the sheriff's office in federal court, saying his treatment failed to meet the standards of the Americans with Disabilities Act (ADA).



Among the concerns raised in his lawsuit was the jail's reliance on teletypewriter devices to allow Deaf inmates to communicate with people outside the jail. The sheriff's office has defended its use of the TTY machine, but Zemedagegehu's lawsuit said the device is useless for someone who can't read English and obsolete because videophones are now used predominantly in the Deaf community.



Zemedagegehu's ordeal began Feb. 2, 2014, when he was arrested after being accused of stealing another man's iPad. He said he pleaded guilty to the charge because a plea bargain offered him a sentence of time served. Later, though, the man who accused him of the theft said he'd found the device and rescinded his accusation.



Under the settlement, the sheriff's office will pay $250,000 to Zemedagegehu, and must take steps to comply with the ADA. This includes appointing an ADA coordinator, providing ADA training to its staff, and ensuring that auxiliary aids and services are provided. The Justice Department said the sheriff's office has taken several steps to improve its ADA compliance even before finalizing the settlement agreement.



"People who are Deaf or Hard of Hearing must be able to communicate clearly with law enforcement officials," said Tracy Doherty-McCormick, First Assistant U.S. Attorney for the Eastern District of Virginia, in a statement Friday. "Through this settlement agreement, the Arlington County Sheriff has taken important steps to ensure that the operations of the Arlington County Detention Facility are in compliance with the Americans with Disabilities Act."

ASL Terp: Stop Calling Sign Language 'Cool'

Deaf News: Let’s talk (or sign!) about the Deaf, not hearing interpreters.



Lexicon Valley - As is consistent with the written and culturally accepted standard, “Deaf” is used to refer to a community, while “deaf” is used to refer to a physiological state of being.



A few days ago, a good friend and fellow linguaphile posted a video on my Facebook wall of Shelby Mitchusson, a hearing American Sign Language (ASL) interpreter translating Eminem’s anthemic “Lose Yourself,” signing with dramatic facial expression and full body motion as she attempts to convey the essence of Slim Shady. The video now has more than 3 million views.



In the fall of 2013, Amber Galloway Gallego became a YouTube sensation after video of her signing a Kendrick Lamar concert also garnered millions of views. Countless articles (here, here, here, and here, to cite a few) lauded Gallego's signing as “epic” and called her “a true inspiration.” Of course, what she’s doing is a service to the Deaf community. Music is something that all people, regardless of their hearing status, should be able to appreciate and understand, and to convey the rhythm and spirit of Kendrick Lamar into a form of expression the Deaf and Hard of Hearing can process is inherently valuable. Mitchusson and Gallego went viral because their videos are not simply a detached interpretation. They're excitingly interpretive.



But what are we really doing when we label ASL with words like "epic" or "cool"? We are exoticizing and trivializing it. ASL (and all sign languages--remember, there isn’t just one!) is a language every bit as much as English, with its own rules of grammar, its own syntax, morphology, phonology, and semantics. It is not “cool” or “interesting” or “awesome," but rather a practical and evolving way of communicating that deserves as much respect as any spoken language. To share a video of someone signing with the caption “look how cool this is!” perpetuates the misconception that sign languages are somehow different, a kind of sideshow novelty at which to marvel... Deaf Bulgarians The Equal Access Campaign

Заслушай се in Bulgarian, is an information campaign managed by a foundation of the same name which focuses public attention on the challenges people who are Deaf and Hard of Hearing face and raises the Bulgarian public’s awareness of hearing health.



Our team is made up entirely of volunteers. Some are Deaf and Hard of Hearing, others cannot but lend an ear to the cause. Our common goal is to ensure equal access for people who are Deaf and Hard of Hearing to information, education and professional development as well as their appropriate involvement in public life.



We work to raise the awareness of hearing health and will provide information about the dangers of noise pollution and the ways to protect one’s hearings.





At present, more than 120,000 people in Bulgaria have various degrees of hearing loss. A large part of them rely mainly on sign language as a means of daily communication and the need for professional sign language interpreters is ever growing. This is why we will support the creation of a modern national centre for sign language and services.

Deaf Justice In Detroit

DETROIT (WXYZ) - Justice is supposed to be blind, but what if it’s also Deaf? The 7 Investigators have learned that jurors who are Deaf are serving on juries more and more.



Judges say in the past, Deaf jurors usually did not make it onto a jury to render a verdict. They’re thrilled that the courts are becoming more inclusive, and as we discovered, Deaf jurors are also changing the dynamics of deliberations.



Inside the Frank Murphy Hall of Justice in downtown Detroit, judges hold more than 500 jury trials every year. In this recent armed robbery trial, not everyone inside Judge Timothy Kenny’s courtroom could actually hear the witnesses.



That’s because for the first time in more than 18 years on the bench, Judge Kenny had the opportunity to seat a Deaf juror to help decide this case.

“I think it’s important for people who do have disabilities to think that this is not a segment of their life that they’re shut out from,” said Judge Kenny.



The court had two highly trained and certified sign language interpreters ready to go the day Juror #13 arrived for jury duty. University Translators Services provided the interpreters for the trial.



They are sworn in and the judge gives them clear instructions that when they’re interpreting inside the jury room for deliberations: they can never express their own views on the evidence.



“They recognize that's what their role is, and they’re not there to provide any editorial comment,” said Judge Kenny.



After 4 days of testimony, juror #13 - the Deaf juror was chosen to deliberate with 11 others. They found the defendant in this case not guilty. “I think every Deaf person has the ability to serve on a jury,” said Leah Scarpace. Deaf Gay Man Sues D.C. Jail For Mistreatment

WASHINGTON, DC - A former inmate in the District of Columbia correctional system is suing the city for alleged mistreatment. The D.C. man is Deaf, and the lawsuit claims he was unable to effectively communicate during his period of confinement. It also alleges his treatment got worse when he complained.



44-year-old William Pierce is profoundly Deaf. He wound up with a 60-day sentence in the city's correction system after an altercation with his partner resulted in a conviction for simple assault.



At the order of the judge, Pierce actually wound up in the Correctional Treatment Facility to get help. The CTF adjoins the city jail.





Arthur Spitzer, an attorney for the American Civil Liberties Union of the Nation's Capital, said in an interview: "There was no interpreter there for [Pierce] at intake, or at any of his medical appointments, he had some medical problems or at any of his classes. He was taking an anger management class, and he didn't know what was going on. He didn't know what people were saying. He couldn't participate in the group discussion(s)."



The lawsuit says, under the Americans with Disabilities Act, accommodations for the Deaf must be made so inmates can communicate. Washington Blade - Gay Deaf man sues city for mistreatment.



WASHINGTON, DC - In a lawsuit filed in federal court on Feb. 1, a former D.C. jail inmate who’s Deaf and gay, accuses the city’s Department of Corrections of engaging in disability-related discrimination by refusing to provide him basic services required by the Americans with Disabilities Act.



William Pierce, 44, who was sentenced to two months in a city jail for an assault conviction, charges in the lawsuit that jail officials repeatedly refused to provide a sign language interpreters as required by law and retaliated against him for complaining about his conditions by placing him in solitary confinement.



Pierce, who has HIV, was given only three of the four HIV medications he had been taking at home and was unable to understand why prison doctors changed his medication regimen because of the lack of a sign language interpreter, the lawsuit says.



It says the emotional distress Pierce suffered due to the alleged discriminatory treatment was heightened when jail guards handcuffed him shortly before his mother arrived for a visit, preventing him from communicating with her in sign language.



The District of Columbia needs to be held accountable for its outright discrimination and reminded that people with disabilities cannot just be locked away and ignored,” said Arthur Spitzer, legal director of the ACLU of the Nation’s Capital, which filed the lawsuit on Pierce’s behalf in U.S. District Court for the District of Columbia.



Spitzer said most of the alleged discriminatory actions against Pierce took place at the D.C. Jail’s Correctional Treatment Facility. The CTF is operated by the Corrections Corporation of America, a private company under contract with the city.



“D.C., in turn, needs to hold the Corrections Corporation of America accountable for its continued disregard for the wellbeing of the individuals the city has placed in its care,” Spitzer said in a statement. ... Deaf Students Outnumber Terps In School

Deaf students outnumber interpreters 2-1; school struggles to meet demand.





MISSOULA - A shortage of sign language interpreters in Missoula has left the University of Montana stretching resources thin for Deaf and Hard-of-Hearing students.



Denise May, the lead interpreter at UM, said Missoula County Public Schools and the University already employ every certified interpreter who wants to work in the region.



"Interpreters are scarce and we could use more," May said. "For example, tomorrow, besides covering all the classes, there's a rodeo club meeting, a mid-year report, a Montana Council for Exceptional Children conference, and others have called asking for interpreters that can work in the community."



There are eight full-time Deaf students attending the University this semester double the number of available full-time sign-language interpreters at UM.

Deaf Woman's Cat Seized By Animal Control Officers



SHELBY, NC. - 'My heart is just broken': Deaf woman's cat seized. A basket of cat toys sits forlornly on the carpet in Cindie Steever's apartment in Shelby along with an empty food bowl.



Steever said her small apartment feels barren and empty without Costello. For Steever, Costello was more than a pet. She was her ears. Steever can't hear a knock on the door. A ringing phone goes unnoticed. She speaks with the help of her fingers and an interpreter. Steever, who is Deaf, told The Star her small gray and white cat would alert her to sounds around her home. Through her interpreter, she described Costello as her "champion hearing cat."



Last week, Costello was taken by Cleveland County Animal Control officers when they were called to her home to remove some kittens. Steever's anguish cannot only be seen in her fingers, but her face. "I relied on her," she said.



Jacquelyn Moore, Steever's friend and interpreter, said Steever felt intimidated by several people. "She thought she was being forced to give Costello up," Moore said. "She felt she didn't have a choice."

Lydia Callis: Pushing Science’s Limits In Sign Language



NEW YORK CITY- Pushing science’s limits in sign language lexicon. Imagine trying to learn biology without ever using the word “organism.” Or studying to become a botanist when the only way of referring to photosynthesis is to spell the word out, letter by painstaking letter.



For Deaf students, this game of scientific password has long been the daily classroom and laboratory experience. Words like “organism” and “photosynthesis” to say nothing of more obscure and harder-to-spell terms have no single widely accepted equivalent in sign language. This means that Deaf students and their teachers and interpreters must improvise, making it that much harder for the students to excel in science and pursue careers in it.



“Often times, it would involve a lot of finger-spelling and a lot of improvisation,” said Matthew Schwerin, a physicist with the Food and Drug Administration who is Deaf, of his years in school. “For the majority of scientific terms,” Mr. Schwerin and his interpreter for the day would “try to find a correct sign for the term, and if nothing was pre-existing, we would come up with a sign that was agreeable with both parties.” Read more: http://www.nytimes.com/2012/12/04/science/sign-language-researchers-broaden-science-lexicon.html

NEW YORK CITY - Fans want Bloomberg's Sandy signer' Lydia Callis back. When New York Mayor Michael Bloomberg appeared at a news conference Wednesday without Lydia Callis at his side, fans of the sign language interpreter immediately expressed their disappointment via Twitter.



"Wait, where is Lydia Callis???? (aka our favorite sign language interpreter)" @abbygardner tweeted.



"Watching Bloomberg's latest briefing. So sad Lydia Callis is not the sign language interpreter #Sandy" tweeted @kyledoyle.



"Damn they change the #signlanguagelady ... WE WANT LYDIA CALLIS BACK !!!!" @JoeyStugotz6 posted.



Callis, 30, became an Internet sensation just three days earlier because of the dramatic facial expressions and body language she used to translate Bloomberg's dire warnings about the dangers coming with Superstorm Sandy as seen: Lydia Callis: Bloomberg's interpreter goes viral.

Chelesa Lately TV Show Under Fire For Mocks Sign Language

VIDEO [ASL/CC] - Host of the Chelesa Lately TV show under fire for mocks American Sign Language.



LOS ANGELES - Late-night host Chelsea Handler (of the Chelsea Lately Show, on E! Network) has found herself in the center of controversy, due to this skit (air date: Oct 30, 2012) the ASL-users community say mocks and makes fun of the language they use to communicate American Sign Language.



In the skit, a member of the cast mocks Mayor Michael R. Bloomberg's ASL Interpreter Lydia Callis, who translated for the Mayor's Hurricane Sandy press conferences, as seen on YouTube video.



Many people unfamiliar with ASL and the plight of the Oralism and Hard of Hearing don't realize that facial expressions and body movements are a part of ASL, and hence it is a protected activity, with communication considered a 'major life activity' under the American With Disabilities Act (ADA).







And what some with hearing (like Chelsea) would consider as "over-exaggerated" facial expressions and body movements are used for a good reason, not to "editorialize" or to be "passionate", but to communicate linguistic elements that those with hearing convey by way of vocal inflection, pitch, rhythm, pace, etc, and take for granted.



America’s largest Deaf organisation, the National Association of the Deaf (NAD) has written an open letter to the producers of a comedy show accusing them of “mocking” American Sign Language. Even, Deaf advocacy organization, Deaf Nation, released a letter the group sent to Handler.

E! Entertainment Television corporate lawyers probably will feel compelled to file a DMCA take-down notice with YouTube (as is their right, as they own the copyright), but I WILL file a DMCA counter-notice, demanding they file suit in Federal Court for copyright infringement. If they need to have a Judge lecture them on the basics of the principle of "fair use" exceptions allowed under U.S. Federal Copyright law, then they can be my guest.



On the other hand, I'm willing to consider relinquishing my right to this "fair use" (public commentary) if the "Chelsea Lately Show" offers a public apology for whatever insult and harm they have caused, perhaps with a statement educating their viewers as to why ASL interpreters must use non-gestural components as a part of ASL, to be broadcast on the Chelsey Lately show in an opening monologue, with a message that is deemed acceptable by representatives of the Deaf community (eg Deaf Nation).

Discussing my thoughts on issues surrounding TV Show - Chelesa Lately's skit on Hurricane Sandy's Breakout Star: Lydia Callis, NY Mayor Bloomberg's Sign Language Interpreter. Making fun of American Sign Language (ASL) in national spotlight is definitely lame and politically-incorrect despite unexpected and pricesless promotion of our beloved and respectful language recently. An interpreter's main role is to convey information rather than become a celebrity for the ignorant. Deaf people are aware of such mainstream fasincation with interpreters and our "beautiful" language. So I bring up the question that is OK to laugh at or laugh with and basically shrug this off? I think this whole publicity stunt is a turkey. I forgot to mention in my vlog: What if this was a terrorist attack rather than a weather crisis in NYC? OK to laugh at or with Lydia's national exposure? I think not.



Responding to Those Who Mock Sign Language.



Lydia Callis, the interpreter for Mayor Bloomberg during Hurricane Sandy, became famous on internet overnight because of her facial expressions. A number of Deaf people have expressed their objection against those who mock the interpreter and American Sign Language, especially the comedian Chelsea Handler. How should we, as Deaf individuals, response to such mockery of our culture and language?

Jokes About Bloomberg's Sign Language Interpreters Aren't Funny

NEW YORK CITY -- These days, a major world event can’t happen without an accompanying meme.



During Hurricane Sandy, the new social media star is Lydia Callis, the American Sign Language interpreter who appears next to the Mayor at press conferences and whose facial expressions have garnered her an internet following and the ultimate status symbol on the internet a fan Tumblr.



Outlets like NPR are calling her “a star” on the level of El Bloombito, the Spanglish-snark Twitter account that added some levity to Hurricane Irene by making fun of Michael R. Bloomberg’s terrible attempts to speak Spanish.





While most of the comments about Lydia online have been positive, they’re positive in an ironic and subtly mocking sort of way. The title of the Tumblr is “Lydia Callis’ face for NYC mayor” not her whole body, just her face.



Laine Nooney, a PhD candidate at SUNY-Stony Brook, tweeted that Callis is “the only SL interpreter I've ever seen who signs with a New York accent.” TruTV’s “Dumb as a Blog” even catalogued 12 of Callis’ facial expressions, giving each a nickname like “The Double Yodas” and “The Hiarious Paperback.”





In some of them, Callis is articulating herself in a way that would be completely relatable to any signer. “The Double Yodas” makes fun of the sign itself two hands in “Y” shapes pulling downward, which can either mean “now” or “today” while purporting to be a joke about Callis’ facial expression in the screencap...

NEW YORK CITY -- 'SNL' You could tell from a mile away that Saturday Night Live was going to use Lydia Callis, Mayor Bloomberg's American Sign Language interpreter, in their opening skit. But was it ... funny?



Callis became an overnight celebrity this week for her animated facial expressions as she interpreted ASL for Michael R. Bloomberg during his many press conferences regarding Hurricane Sandy . But as journalist Lilit Marcus wrote over at the Atlantic, much of the coverage of Callis was patronizing to ASL speakers.





Marcus is the child of two hearing impaired parents and was dismayed, if not entirely surprised, that the hearing world seemed to think Callis was there to provide goofy entertainment.



Yes, Lydia Callis’ facial expressions and large, emphatic signs are a bit unusual among interpreters, but they’re not incorrect. Most interpreters have a difference between the way that they sign for large groups and the way that they sign for small ones.



Callis’ sign style reminds me more of the way that interpreters translate at Broadway shows or at college graduations, but that doesn’t mean it’s wrong or that she’s doing it for attention... Read More.

When ASL interpreter Lydia Callis shot to fame because of her use of facial expressions while interpreting New York Mayor Michael Bloomberg and Chris Christie’s 'Frankenstorm' Sandy press conference last weeks ago. Therefore, they say that “the way this woman on your show gestured in an ugly fashion was a totally offensive mockery of American Sign Language.”

Late-night host Chelsea Handler of the Chelsea Lately Show, on E! Network has found herself in the center of controversy, due to this skit air date: Oct 30, 2012 which many members of the Deaf community say mocks and makes fun of the language they use to communicate: ASL American Sign Language. In the skit, a member of the cast mocks Mayor Bloomberg's ASL Interpreter Lydia Callis, who translated for the Mayor's Hurricane Sandy press conferences.

NEW YORK CITY -- Oscar winner Marlee Matlin has lashed out at "Saturday Night Live" for poking fun at sign language during the opening skit on Saturday's show.



As regulars Fred Armisen and Bobby Moynihan impersonated New York Mayor Michael Bloomberg and New Jersey Governor Chris Christie in the press conference sketch about the Hurricane Sandy disaster, two castmates offered comic signing beside them, which aired for the hearing-impaired people.





But the hearing impaired Matlin wasn't laughing, she found the skit offensive and took to Twitter.com to slam the show's producers and the stars themselves...

Frankenstorm Prompts Mass Evacuation In New York City

NEW YORK CITY - Hurricane 'Frankenstorm' Sandy - The mayor of New York City, Michael Bloomberg ordered the mandatory evacuation of hundreds of thousands of residents as Hurricane Sandy roars towards the east coast of the United States and parts of Canada, bringing punishing winds, heavy rainfall and storm surges.



At a press conference Sunday, Michael Bloomberg said some 375,000 people in a number of coastal areas including Coney Island, Lower Manhattan and parts of the Queens neighbourhood would need to leave their homes. He said those affected would have to stay with family and friends outside of the evacuation area or at one of the 72 shelters the city has set up.

Bloomberg: I'm Going to Sign an Evacuation Order





New York City announced the closings of it mass transit and school systems, both the nation's largest, and ordered residents to leave some low-lying areas Sunday ahead of the massive storm approaching the eastern third of the U.S.



Hurricane Sandy: 'Don't Be Stupid, Get Out And Go To Higher, Safer Ground,' Officials Said.



ABC NEWS - Tens of thousands of people in coastal areas have been ordered to evacuate their homes before Hurricane Sandy pounds the eastern third of the United States with life-threatening storm surges, forceful winds and rainfall that could cripple transportation and leave millions without power.



"Don't be stupid. Get out and go to higher, safer ground," New Jersey Governor Chris Christie said today. "Let's get to work on this. We know how to do this. We've been through this before."



States of emergency were declared from North Carolina to Connecticut. Coastal communities in Delaware were ordered to evacuate by 8 p.m. tonight.



As of 5 p.m. EST today, Sandy was moving toward the northeast at nearly 15mph, slightly faster than it was measured earlier today. It is expected to take a turn to the north and then northwest, bringing the center of the nearly 900-mile storm to be near the mid-Atlantic coast Monday night.



Sandy is expected to bring potentially life-threatening storm surges on the coast ranging from several feet to potentially as high as 11-feet in the Long Island Sound area of New York, said Rick Knabb, director of the National Hurricane Center..
